Terms of Service

Welcome to MatchPly! These Terms of Service ("Terms") govern your access to and use of the MatchPly mobile application and website (collectively, the "Service"), provided by MatchPly ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to register for an account on MatchPly. Minors under the age of 18 ("Minors") may only use the Service under the direct supervision of a parent, legal guardian, or an authorized sports instructor/coach.

If you create an account or register a Minor to use the Service as a parent, guardian, or authorized instructor, you represent and warrant that you have the legal authority to do so, and you agree to be fully bound by these Terms and take full legal and financial responsibility for the Minor's conduct and actions on the platform and during any arranged matches.

Minors are strictly prohibited from creating accounts independently.

2. Account Registration and Security

To use certain features of the app, you must register for an account. You agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your password and log-in credentials.
  • Promptly update your information if it changes.
  • Notify us immediately at support@matchply.com if you suspect any unauthorized access to your account.

You are solely responsible for all activities that occur under your account.

3. User Conduct and Prohibited Activities

MatchPly is built on community and fair play. You agree that you will not engage in any of the following prohibited behaviors:

  • Harassing, bullying, threatening, or intimidating other users either online or during physical matches.
  • Creating fake accounts, impersonating others, or providing false match statistics.
  • Using the Service for any commercial, advertising, or spamming purposes without our prior consent.
  • Attempting to scrape data, reverse-engineer the app, or disrupt our servers.
  • Engaging in illegal or dangerous activities while participating in matches arranged through the platform.

4. Intellectual Property Rights

The Service, including its logo, design, text, graphics, source code, and all software, is the exclusive property of MatchPly and is protected by United States and international copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial use only.

5. Fees, Payments, and Subscriptions

MatchPly may offer premium features, subscriptions, or tournament/booking fees. All transactions are subject to our payment processors' terms (e.g., Apple Pay, Google Play, Stripe).

  • Cancellation: If you purchase a subscription, it will automatically renew until canceled. You must cancel via your device's subscription settings to avoid future billings.
  • Refunds: All purchases are generally non-refundable unless required by law or specified in our Support/Refund policy.

6. Termination of Accounts

We reserve the right, in our sole discretion, to suspend, disable, or permanently terminate your account and access to the Service at any time, without prior notice or liability, if we determine you have violated these Terms, engaged in misconduct, or pose a safety risk to the MatchPly community.

7. Disclaimers and Limitation of Liability

YOUR USE OF THE SERVICE AND PARTICIPATION IN ANY ARRANGED SPORTS ACTIVITIES IS ENTIRELY AT YOUR OWN RISK. THE LIMITATIONS AND DISCLAIMERS SET FORTH IN OUR SEPARATE DISCLAIMER PAGE ARE FULLY INCORPORATED INTO THESE TERMS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MATCHPLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO BODILY INJURY, PROPERTY DAMAGE, OR DATA LOSS ARISING OUT OF YOUR USE OF THE APP OR INTERACTIONS WITH OTHER USERS.

8. Governing Law and Jurisdiction

These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles. Any legal action not subject to the Arbitration section below shall be brought exclusively in the federal or state courts located in Williamson County, Texas.

9. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Binding Arbitration

You and MatchPly agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association ("AAA") in Williamson County, Texas, rather than in court.

Class Action Waiver

YOU AND MATCHPLY AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
